Another year has started following the eventful 2020 and 2021. Some of us may look back on these years with anxiety and sadness. But 2022 has arrived and it is a New Year bringing with it new ideas, new opportunities, a new way of living and hopefully some travelling locally and abroad.
In the pharmaceutical sector, 2022 brings new challenges such as licencing deadlines, call ups for complementary medicines, COVID antiviral drugs and fierce debates over vaccine mandates. At Pharmalaw, we endeavour to keep ahead of these new developments.
Pharmalaw started 2022 with good news. We were involved as pharmaceutical law expert in the case ACPSA (The Association of Compounding Pharmacists of South Africa) v Minister of Health and others (GNP) (unreported) case number 15758/2018 of 13 December 2021. In short, contested regulations pertaining to compounding were reviewed and set aside on specific premises. The judgement was suspended for a period of seven months and the matter was referred back to the Minister of Health to redraft the regulations. Costs was awarded.
In the aftermath of the Flordis South Africa (Pty) Ltd v The Commissioner of the South African Revenue Service 2019 JDR 2299 (GP) and the Supreme Court of Appeal’s refusal to grant leave to appeal that judgment, SARS conceded several matters in which Pharmalaw was also involved as pharmaceutical law expert. These all related to the correct tariff determinations of specific complementary medicines. Hopefully this brings similar disputes to an end since the judgement dealt definitively with classification of medicaments for customs duty purposes.
But we cannot only look back on disasters and successes, we have to look forward.
